Terms of Service
Creto is operated by Varkala Technologies Pvt. Ltd. (“Creto”, “we”, “us”, or “our”). By accessing or using the Creto platform, including our mobile applications and brand portal, you agree to these Terms of Service. If you do not agree with these terms, you should not use the platform.
Creto is a platform that connects audiences, content creators, and brands. Users can discover creators and connect with them through paid, pay-per-minute calls. Creators can use Creto to offer paid connections, manage their earnings, and discover and participate in brand collaborations. Brands can use the platform to discover creators, publish campaigns, and manage creator collaborations.
You are responsible for providing accurate and complete information when creating your account and for keeping your account credentials secure. You must not create an account using false information, impersonate another person or entity, or use another person's account without authorization. You are responsible for all activities carried out through your account.
Creators are responsible for the information, content, services, pricing, availability, and representations they provide through Creto. Creto provides the technology and marketplace to facilitate connections between users and creators but does not guarantee the quality, accuracy, availability, expertise, or outcome of any creator interaction or service. Any communication or relationship between a user and a creator is primarily between those parties.
Paid calls on Creto are charged according to the creator's applicable per-minute rate and the duration of the call. Users are responsible for reviewing the applicable price before starting a paid call. Charges may be processed through third-party payment providers. Once a call has been completed, charges may generally be considered final except where a refund or adjustment is required under Creto's policies or applicable law.
Creators are responsible for managing their availability and ensuring that the information they provide about themselves and their services is accurate. Creators are also responsible for complying with applicable laws, regulations, tax obligations, advertising requirements, and professional requirements relating to their activities on the platform.
Brands may use Creto to publish campaigns and collaborate with creators. Brands are responsible for providing accurate campaign information, budgets, requirements, deadlines, and deliverables. Creators are responsible for fulfilling the commitments they accept as part of a brand collaboration. Creto facilitates the relationship and related transactions but is not responsible for the commercial success, performance, or outcome of a brand campaign.
All users must use Creto lawfully and responsibly. You must not use the platform to engage in fraud, scams, harassment, abuse, discrimination, impersonation, misleading activities, unauthorized commercial activity, or any activity that violates applicable law. You must not attempt to interfere with the operation or security of the platform, gain unauthorized access to accounts or systems, distribute malicious software, or misuse another person's information.
Users and creators are responsible for the content they upload, publish, transmit, or otherwise make available through Creto. You must ensure that you have the necessary rights and permissions to use such content. You must not upload or distribute content that infringes intellectual property rights, violates privacy rights, contains unlawful material, or otherwise violates these Terms.
Creto may charge platform fees, transaction fees, commissions, or other applicable charges for certain services. Any applicable fees will be communicated through the platform before or during the relevant transaction. Creto may change its pricing or fee structure from time to time.
Payments, refunds, withdrawals, and creator earnings may be subject to additional requirements, verification procedures, payment-provider rules, and applicable laws. Creto may delay, restrict, or withhold transactions where reasonably necessary to investigate fraud, disputes, security concerns, or legal or regulatory requirements.
Creto may suspend, restrict, or terminate an account if we reasonably believe that the user has violated these Terms, misused the platform, engaged in fraudulent or harmful activity, or created a security or legal risk. We may also remove content or restrict access to specific features where necessary to protect the platform and its users.
Creto may modify, suspend, or discontinue any feature or part of the platform at any time. We will make reasonable efforts to maintain the availability of the platform, but we do not guarantee that the platform will always be available, uninterrupted, error-free, or free from technical issues.
Creto is provided as a platform that facilitates connections and transactions between users, creators, and brands. To the maximum extent permitted by applicable law, Creto is not responsible for the actions, statements, services, content, products, promises, or conduct of users, creators, or brands using the platform. Users should exercise their own judgment when interacting with other parties.
To the maximum extent permitted by applicable law, Creto and Varkala Technologies Pvt. Ltd. will not be liable for indirect, incidental, special, consequential, or similar losses arising from the use of the platform or interactions between users, creators, and brands.
These Terms are governed by the applicable laws of India. Any disputes arising in connection with these Terms or the use of Creto will be subject to the jurisdiction of the courts having appropriate jurisdiction in India.
We may update these Terms of Service from time to time to reflect changes to the platform, our business practices, or applicable legal requirements. Continued use of Creto after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.
